1.- Website Ownership

In accordance with article 10 of Law 34/2002 of the 11th July, on Services for the Society of Information and Electronic Commerce (henceforth ‘LSSI’, its acronym in Spanish), we hereby notify you that the website https://cefi.es/ (henceforth, the ‘Website’) is operated by CENTRO DE ESTUDIOS PARA EL FOMENTO DE LA INVESTIGACIÓN CEFI FUNDACION PRIVADA (henceforth, ‘CEFI’), with VAT identification number G-08793499, registered in the Registry of Ministry of Education, Social Policy, and Sports, with inscription number 115, whose registered office is located at Avda. de Brasil 17 9ºB, Madrid 28020.]]>

2.‐ Use of the Website

This Legal Notice (henceforth, the ‘Legal Notice’), establishes the conditions which regulate the use of the services of the information society that CEFI makes available to the users of the internet through their Website.

The aspects relating to the processing of personal data of users with regards to the use of the Website are regulated in the Privacy Policy.

In this way, access to and use of the Website means that the user (henceforth, the ‘User’) accepts entirely and agrees to fully comply with this Legal Notice, the Privacy Policy the Cookies Policy, as well as the instructions or recommendations which may be indicated in each specific case through the Website.

Access to the Website is free, except with regards to the connection cost through the telecommunications network provided by the provider the User has retained.

CEFI reserves the right at any time and without prior notice, to make any modifications and updates to the Website and its content, configuration and presentation, including this Legal Notice, and for this reason we recommend that the User re-read it prior to each visit and use of the Platform. CEFI shall place these conditions in a visible place, freely accessible for as many consultations as may be required by the User.

The User agrees not to use the Website for fraudulent purposes, as well as undertaking not to act in a manner which may damage the image, interests and rights of CEFI or any third party, undertaking to use the Website, the services and the content included therein in a diligent, correct and lawful manner. In particular, the User agrees to abstain from: removing, avoiding or manipulating ‘copyright’ and other identifying data of the rights of owners included in the content of the Website, as well as the technical protection devices or any other information mechanisms that could include said content. Furthermore, the User agrees not to do anything with the aim of damaging, rendering useless or overloading the Website or which may hinder, in any way, the normal use and function of the Website.

As a result of the above, the User is solely responsible before CEFI and third parties for:

• The consequences which may derive from the use, with unlawful aims or in contravention of this document, of any content of the Website, created by CEFI or any third party.
• The consequences which may arise from the improper use in contravention of this document and which may damage the interests or rights of third parties, or which in any way may damage, render useless or deteriorate the Platform or its services or impede the normal enjoyment by other Users.

Should you breach this Legal Notice or should CEFI reasonably suspect that you are breaching it, CEFI reserves the right to limit, suspend or terminate your access to the Website, adopting any technical means necessary to this end. Furthermore, CEFI reserves the right to decide, at any time if it continues to provide the services provided through the Platform.

3.‐ Intellectual and Industrial Property

The intellectual property rights regarding the use of the content of the Website (including the sui generis right to the database), its graphic design (look and feel), distinctive marks (trade marks and trade names), underlying computer programmes (including source codes, as well as the different elements that make up the Platform (text, graphics, videos, etc.) belong to CEFI or as the case may be, CEFI has the right to use them, and to this end are works protected by applicable intellectual and industrial laws currently applicable and in force.

Use of the Website by the User in any way assumes the assignment of an intellectual and/or industrial property right over the Platform, its content and/or distinctive marks of CEFI. To this end, through this Legal Notice, with the exceptions of those cases in which it may be legally permitted, it is expressly prohibited for the User to reproduce, transform, distribute, publicly communicate, make available, extract and/or reuse the Website, its content and/or the distinctive marks of CEFI either partially or in their totality.

It is expressly and entirely prohibited to reproduce or copy elements or content of the Website created with the intent to profit or with commercial aims. Furthermore, it is completely prohibited to copy, reproduce, adapt, modify, distribute, commercialise, publicly communicate and/or any other action which may lead to a breach of the current Spanish and/or international law with regards to intellectual and/or industrial property, as well as the use of content from the web without the prior, express and written authorisation from CEFI.

4.‐ Limitation of Liability

CEFI applies the technical and organisational measures appropriate to guarantee an adequate level of security. To this end, CEFI manages its server environment adequately, with a firewall infrastructure which is strictly complied with and by continuously using up to date technology to ensure the confidentiality and privacy of information is not compromised.

The User recognises and accepts that the use of the Website is at all times at their sole and entire risk and responsibility and CEFI shall not be responsible for any misuse or incorrect use which may occur. To this end, CEFI shall only be responsible for any damages the User may suffer for use of the Website when said damages are due to our fraudulent use.

In particular, and without limitation, CEFI shall not be liable for:

• The content of sites linked through the links included within the Website. In this regard, the terms detailed in clause 5 of this Legal Notice shall apply.
• The damages of any kind caused in the IT equipment of the User due to virus, worm, trojan or any other kind of damaging element. The User recognises that the use of the Internet incurs an assumption of risk to IT equipment which may be affected by the elements detailed. To this end, it is the User, in any case, who should have the adequate tools for the detection and elimination of damaging electronic programmes.
• The damages of any type caused by the User which may cause glitches or disconnections in the telecommunications network which produce the suspension, cancellation or interruption of the Website service during the provision of it or prior to the provision of the service. In this regard, the User recognises that access to the Platform requires services provided by third parties outside of the control of CEFI (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and functioning does not rely on CEFI.
• The use which the User may make of the material of this Website, whether prohibited or permitted, in breach of intellectual and/or industrial property rights of Website content or of third parties.
• The acts or omissions of third parties, regardless of whether these third parties may be linked to CEFI contractually.
• The communications or dialogue during debates, forums, chats or virtual communities which may be organised through the Website, nor shall it be liable therefore, for the consequential damages which the User or third parties may incur as a result of said communications and/or dialogue.

Under no circumstance shall CEFI be held liable for:

• The errors or delays in access to the Website by the User when including its data in the request form, the slow service or impossibility of receipt on the part of recipients of an order confirmation or any anomaly which may arise when these issues are due to problems in the telecommunications network, unforeseeable circumstances or force majeure and any other unforeseeable and contingency unrelated to the good faith of CEFI.
• The errors or damages caused by the Website due to an inefficient service and bad faith on the part of the User.

In any case, CEFI undertakes to resolve issues which may arise and to offer all support necessary to the User to reach a quick and satisfactory solution to the incident.

5.- Links to other internet sites

The Website includes links which permit the User to access other internet pages and portals (henceforth, the ‘Linked Sites’).
In these cases, CEFI acts as a provider of services as an intermediary in accordance with article 17 of LSSI, and shall only be responsible for the content and services supplied to these Linked Sites to the extent that it is effectively aware of its unlawfulness and has not deactivated the link with the necessary due diligence. In the case that the User considers that there is a Linked Site with unlawful or inadequate content, we ask that you contact CEFI at info@cefi.es Under no circumstances shall this communication incur an obligation to remove the corresponding link.

The existence of Linked Sites under no circumstances means that CEFI has effective or any other kind of knowledge of the services and content contained therein in case of unlawfulness, nor that it necessarily maintains agreements with the responsible parties or owners of the Linked Sites. The existence of said links does not imply the recommendation, promotion, identification or conformity of CEFI with the statements, content or services provided through the Linked Sites. As a result, CEFI shall not be responsible for the content of Linked Sites, nor for the conditions or use and confidentiality policies, and it is the User who shall be solely responsible to verify and accept them each time he or she accesses them.

The User and, in general, any physical or legal person who wishes to establish a link from their page or site to the Website, must have a prior written authorisation from CEFI. The establishment of said link does not in any case imply the existence of a relationship between CEFI and the owner or title-holder of the site or page on which it appears, nor the acceptance nor approval by CEFI of its content or services.

The inclusion of any kind of link from an unrelated page or site to any page of the Platform of CEFI shall be subject to the following conditions:

The total or partial reproduction of any of the services contained in the Website is not permitted.

No false, inexact or incorrect statement with regard to the Website or its services shall be included.

Under no circumstances shall CEFI be responsible for the content, information, statements, opinions or services made available to the public on the page from the inclusion of the link on the Website.

Any link shall be set out on the main page of the Website.

In any case, CEFI reserves the right to prohibit or render unusable at any time the links to the Website, especially in cases of unlawfulness of the activity or content of the pages or site on which they are contained.

6.- General

The use of the Website is restricted and interpreted in accordance with Spanish Law, and any conflict or litigation which may arise between the user and CEFI shall be heard by the competent courts and tribunals in accordance with the applicable legislation.

Should any of the clauses contained in this Legal Notice be declared entirely or partially null and void, they shall either be removed or replaced. In any case, said declaration of nullity shall not affect the validity of the remaining clauses contained in this Legal Notice.
