1.- Ownership of the Website


In accordance with the provisions of Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (hereinafter, the “LSSI”), we hereby inform you that the website https://cefi.es/ (hereinafter, the “Website”) is operated by CENTRO DE ESTUDIOS PARA EL FOMENTO DE LA INVESTIGACION CEFI FUNDACION PRIVADA (hereinafter, “CEFI”), with Tax ID No. G-08793499, registered in the Registry of the Ministry of Education, Social Policy and Sport under registration number 115, with its registered office at Pio XII, 49 Loft 1, 28016 Madrid.






2.- Use of the Website


This Legal Notice (hereinafter, the “Legal Notice”) sets out the conditions governing the use of the information society services that CEFI makes available to Internet users through the Website.


Matters relating to the processing of users’ personal data arising from the use of the Website are regulated in the Privacy Policy.


Likewise, information regarding the use of cookies can be found in the Cookies Policy.


Accordingly, access to and use of the Website implies that the user thereof (hereinafter, the “User”) fully accepts this Legal Notice, the Privacy Policy and the Cookies Policy, and undertakes to comply with them in full, as well as with any instructions or recommendations that may be provided in each specific case through the Website.


Access to the Website is free of charge, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.


CEFI reserves the right to make, at any time and without prior notice, modifications and updates to the Website and its contents, configuration and presentation, including this Legal Notice. Therefore, we recommend reading it before each access and browsing of the Platform. Any modification will be stated by means of a pop-up notice. CEFI will display these conditions in a visible and freely accessible place for any consultations that may be carried out.
CEFI will inform users at the beginning of browsing this website of any modifications made, whenever necessary.


The User undertakes not to use the Website for fraudulent purposes, nor to engage in any conduct that could damage the image, interests or rights of CEFI or third parties, and undertakes to use the Website, the services and the contents included therein diligently, correctly and lawfully. In particular, the User undertakes to refrain from: removing, circumventing or manipulating the “copyright” and other identifying data of the rights holders incorporated into the contents of the Website, as well as technical protection devices or any information mechanisms that may be included in such contents. Likewise, the User undertakes not to perform any act intended to damage, disable or overload the Website, or that in any way prevents its normal use and operation.


As a consequence of the foregoing, the User shall be solely responsible vis-à-vis CEFI and third parties for:



  • Any consequences that may arise from the use, for unlawful purposes or effects or in breach of this document, of any content of the Website, whether created by CEFI or any third party.

  • Any consequences that may arise from use contrary to the content of this document and harmful to the interests or rights of third parties, or that in any way may damage, disable or deteriorate the Platform or its services or prevent other Users from normal enjoyment thereof.


In the event that the User breaches this Legal Notice, or if CEFI reasonably suspects that it is being breached, CEFI reserves the right to limit, suspend or terminate the User’s access to the Website, adopting any technical measures necessary for that purpose. Likewise, CEFI reserves the right to decide, at any time, on the continuity of the services provided through the Platform.






3.- Intellectual and Industrial Property


The intellectual property rights over the arrangement of the contents of the Website (including the sui generis right over the database), its graphic design (look & feel), distinctive signs (trademarks and trade names), underlying computer programs (including source codes), as well as the different elements that make up the Platform (texts, graphics, logos, designs, photographs, videos, etc.) belong to CEFI or, where applicable, CEFI holds the right to use and exploit them, and therefore they constitute works protected by the applicable intellectual and industrial property regulations.


The User’s use of the Website does not imply any transfer of intellectual and/or industrial property rights over the Platform, its contents and/or CEFI’s distinctive signs. For this purpose, by virtue of this Legal Notice, except in those cases where it is legally permitted, the reproduction, transformation, distribution, public communication, making available, extraction and/or reuse of the Website, its contents and/or CEFI’s distinctive signs, whether in whole or in part, is expressly prohibited.


The reproduction of elements or contents of the Website for profit or commercial purposes is expressly and strictly prohibited. Likewise, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that constitutes an infringement of Spanish and/or international regulations on intellectual and/or industrial property, as well as the use of the contents of the website without the prior express written authorization of CEFI, is strictly prohibited.






4.- Limitation of Liability


CEFI applies appropriate technical and organizational measures to ensure an adequate level of security. In this regard, CEFI properly manages its server environment, has a strictly compliant firewall infrastructure, and continuously uses current technologies to ensure that the confidentiality and privacy of information are not compromised.


The User acknowledges and accepts that use of the Website is at all times carried out at the User’s own risk and responsibility, and therefore CEFI shall not be liable for misuse or improper use thereof. For this purpose, CEFI shall only be liable for damages that the User may suffer as a result of using the Website when such damages are due to CEFI’s willful misconduct.


In particular, by way of example but not limited to, CEFI shall not be liable for:



  • The content of websites linked through links included within the Website. In this respect, the terms set out in section 5 of this Legal Notice shall apply.

  • Any damages of any kind caused to the User’s computer equipment by viruses, worms, trojans or any other harmful element. The User acknowledges that use of the Internet involves assuming the risk that their computer equipment may be affected by the aforementioned elements. In this regard, it is the User’s responsibility to have appropriate tools available for the detection and removal of harmful electronic programs. CEFI will review and implement the necessary measures so that access to its website does not pose a computer virus risk.

  • Any damages of any kind suffered by the User arising from failures or disconnections in telecommunications networks that result in suspension, cancellation or interruption of the Website service during its provision or prior thereto. In this respect, the User acknowledges that access to the Platform requires services provided by third parties outside CEFI’s control (for example: telecommunications network operators, access providers, etc.), whose reliability, quality, continuity and operation are not attributable to CEFI.

  • The use that the User may make of the materials on this Website, whether prohibited or permitted, in infringement of the intellectual and/or industrial property rights of the contents of the Website or of third parties.

  • Communications or dialogues in the course of debates, forums, chats and virtual communities that may be organized through the Website, and therefore it shall not be liable for any damages that the User or third parties may suffer as a result of such communications and/or dialogues.


Under no circumstances shall CEFI be liable for:



  • Errors or delays in access to the Website by the User when entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation, or any anomaly that may arise when such incidents are due to telecommunications network problems, events of force majeure or any other unforeseeable contingency beyond CEFI’s good faith.

  • Errors or damages caused to the Website due to inefficient and bad-faith use of the service by the User.


In any case, CEFI undertakes to resolve any problems that may arise and to offer all necessary support to the User in order to reach a quick and satisfactory solution to the incident.






5.- Links to Other Internet Sites


The Website includes technical link devices that allow the User to access other websites and Internet portals (hereinafter, “Linked Sites”). In such cases, CEFI acts as an intermediary service provider in accordance with Article 17 of the LSSI, and shall only be liable for the contents and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not deactivated the link with due diligence. If the User considers that there is a Linked Site with unlawful or inappropriate contents, please notify CEFI at info@cefi.es. Under no circumstances shall such communication entail an obligation to remove the corresponding link.


The existence of Linked Sites does not imply that CEFI has actual or any other knowledge of the services and contents thereof in case of unlawfulness, nor that it necessarily maintains agreements with those responsible for or owners of the Linked Sites. Nor does the existence of such links imply any recommendation, promotion, identification or approval by CEFI of the statements, contents or services provided through the Linked Sites. Consequently, CEFI is not responsible for the content of the Linked Sites, nor for their terms of use and confidentiality policies, and the User is solely responsible for checking and accepting them each time they access and use them.


The User and, in general, any natural or legal person intending to establish a link from their website or site to the Website must obtain prior written authorization from CEFI. The establishment of such a link does not in any case imply the existence of relations between CEFI and the owner or holder of the website or page where it is established, nor the acceptance or approval by CEFI of its contents or services.


The establishment of any link from a page or site external to any of the pages of the CEFI Platform shall be subject to the following conditions:



  • The reproduction, in whole or in part, of any of the services contained on the Website is not permitted.

  • No false, inaccurate or incorrect statement shall be made about the pages of the Website and its services.

  • Under no circumstances shall CEFI be liable for the contents, information, statements, opinions or services made available to the public on the page from which a link to the Website is established.

  • Any link shall be made to the main page of the Website.

  • In any case, CEFI reserves the right to prohibit or disable at any time links to the Website, especially in cases of unlawful activity or content on the page or site where the link is included.





6.- General Provisions


Use of the Website shall be governed and interpreted in accordance with Spanish law. Any conflict or dispute arising between the User and CEFI shall be submitted to the competent courts and tribunals in accordance with applicable legislation.


If any of the provisions contained in this Legal Notice is declared null and void in whole or in part, it shall be removed or replaced. In any case, such declaration of nullity shall not affect the validity of the remaining provisions contained in this Legal Notice.
